Abstract
This work addresses the discussion inaugurated by Tiziana Chiusi in 1993 regarding that the limits within the merx peculiaris could be constituted as special patrimony. The author analyses the context in which the merx peculiaris develops, as well as the status of the sources, so as to discuss Chiusi's thesis.
