Resumen
This paper is based on the analysis of D.19.2.33, of African, in relation to the problem of the risk in buying and selling. In this sense, together with offering a synthesis of the main contributions of the doctrine about the exegesis of the fragment, discusses the dominant thesis, which prefers inserting the interpretation of the passage within the wide range of problems related to the contractual responsibility and, against said perspective, studies in depth the hypothesis which states we would be facing an important classic testimony against the alleged validity without alleviations from the periculum est emptoris rule.
